They could also decline to fix it if it was just driven hard.  Chip or no 
chip.  The dealer however(this was the way it was explained to me by the 
dealer) is better off not bringing up the mods even if they found them.  In 
most cases the people can't afford to repair at the dealership, so they 
loose the job.  So they just don't mention them to VW and fix it.  They are 
money hungry.

Bryan, Yes a chip will not cause a crank to warp. The engine I replaced
failed because of a manufacturing defect. I just hope this car was an
isolated incidence.  Volkswagen is getting dead serious with owners who
modify there cars.  Just because you went to a mod friendly dealer does not
mean All dealers are mod friendly.  As soon as a mod friendly dealer gets
charged back for warranty work they to will become mod unfriendly.  Yes the
burden of proof is on VW before they decline to cover a repair under
warranty. However it is not hard to see if a chip is installed. I have been
able to detect Garretts chips in OBD I and OBD II cars using a VAG 1551.

Here is an example of what could happen.   GLX comes in with a hole in the
transmission case because of flying differential rivets. The technician
finds that the engine ECM has been chipped. VW makes the decision not to
cover the repairs because of driver abuse.
What happens now?  Do you think the Mod friendly dealer will step forward
and pick up the bill? I don't think so.

Don
