I would think any work performed by a dealer, paint or engine repair, etc. would be in fact covered by the dealer. To be considered under the lemon law I would also think you have to prove the dealer did not make reasonable restitution, or at least failed at doing so after a few attempts. Sounds like a new car would be great but painting is reasonable. The paint job would be under warranty and if you are worried that it wouldn't be you could always get that part in writing.
