Re: negative connotations



If these snips from news reports are any indication,
there is alot of misinformation out there.  Me no
happy either!

Check out the link to the UK gov't circular intended
to guide police in when/how/who they issue cautions
to. It pretty much says what you did: the police use
them when there is enough evidence to convict someone
but extenuating circumstances recommend against
prosecution (first timer, shows remorse, old or
infirm, &c.); and the "suspect" is willing to admit to
the offense.

To be accurate, he was arrested on _suspicion_ of
these three things.  They never "alleged" or charged
that he did them but they may have seen enough in that
90 minutes at his house to suspect along those lines.

The terminology may be pro forma - I read during my
timeline research that UK courts have ruled that
downloading an image is tantamount to making it,
because your hard drive writes it in the process. 
They may well interpret there being a copy in a temp
folder somewhere to be "possession" and the mere fact
that one has an email program on the same PC to be
tantamount to readiness to distribute.

You're correct, Scott. He was not jailed - he was
"arrested" - brought in for questioning and released
on bail, which technically he is still under.

None of this bodes well to me, as it seems to be
leading in the direction that the police have him over
a barrel and his "best" decision may well be to take
the caution - even if it doesn't reflect what
happened. Fighting the fight to prove the last point
might do him and those close to him more damage than
this option.  

I can't help but think he is not in a position to
decide much if only because he said on March 6th, "I
hope that the Police will make their decision very
soon..." That almost suggests that they hadn't even
decided yet whether they were going to offer him a
caution versus filing charges.
