What do you mean by protection?

We still have the million dollar exception, to sign him even if we 
use up the midlevel, and we can sign him to a minimum contract for 
this year with more of a pat on the back going forward regardless.

Don't see how you can be bringing Bird rights in (your subject line) 
since those only apply to players you already have under contract.
