My gf grandparents were just in an accident in a situation almost exactly
like you described....they where 25% at fault, the other driver was 75% at
fault...it didn't matter that they other driver was doing 18mph over either,
and that an off duty cop was phoning the car in for reckless driving.  You
will always have some of the blame..doesn't matter if you are in the car or
not.  I had my car get hit once -- it was legally parked, well with in the
lines, I was out of the car (several blocks away).  Some lady creamed the
back of my car, pushed my car 40 feet.  I was considered to be 5% at fault
simply for parking my car outside and not having it at home in the garage.

just a question for all you guys...today i was almost in an accadent i was
stoped at a stop sign and making a left the car coming from the left stoped
to turn right as i was pulling out some guy in a ford came zooming around
the
car that was turning right and almost hit me whos fault would that have
been...btw it was a no passing zone.
